Apply for panel of Special Public Prosecutor for Income Tax Department of Delhi.

Applications are invited for empanelment as Special Public Prosecutors to represent Income Tax Department before Court of Sessions/Court of Economic Offences and its subordinate Courts in Prosecution cases of Direct Taxes.

Qualification Required for Special Public Prosecutor

In order to be eligible for engagement as an SPP, a person should:

a) Be eligible lo appear before the court as an Advocate &

b) Have a minimum experience of 7 years as a Practicing Advocate in Criminal Matters.

Desirable : Experience of handling trial related to Direct Taxes.

Procedure for Engagement of Special Public Prosecutor

1. Chief Commissioner of Income tax (CCIT) shall call Application in Proforma P 1. (Proforma P1 is available in the original link of Notification mentioned below).

2. CCIT shall form Five Member Screening Committee for the purpose of evaluation of proposals. The CCIT shall forward the proposal to the board with his recommendations along with the report of the Screening Committee.

3. The First engagement shall be for the period of 18 months which shall be renewable subject to the recommendation of CCIT along with the Annual Performance Appraisal Report.

Right to Private Practice

1. The SPP will have right to do private practice but he shall not appear in the prosecution matters against the department of Income Tax in any court.

2. If the SSP happen to be partner of Any Law Firm then that law firm shall not take up any prosecution case against the Income Tax Department.

Schedule of Fees, Allowances and Terms of Payment

Effective Hearing :2000/- Per Day Per case.

Ineffective hearing : 500/- Per Day Per Case

Drafting Complaints : 2000 /- Per Complaint

Drafting Revision, Replies etc : 1000/-

Conference Fee : 750 /- per conference

Clerkage : 10 %of effective Hearing

Opinion Fees : 2000/- per case
